Judge Removes a Defendant in Newspaper Battle

Santa Fe, NM, Federal District Judge Santiago Campos has removed New Mexican Inc as defendant in court battle over ownership of Santa Fe's only daily newspaper; Campos rules that New Mexican is inseparable from its parent corp, Gannett Co; ruling means that newspaper will not present final arguments in trial of lawsuit brought by Robert McKinney, former owner of newspaper, McKinney filed suit against Gannett and New Mexican in September '78, contending that defendants had breached employment contract he received when he transferred newspaper to Gannett in '76; under employment contract, McKinney was to retain several top positions at newspaper for 5 years after merger; McKinney is seeking return of newspaper, $25 million, or both, in trial (M)
