Justice Dept on Oct 8 brands as 'frivolous' Vice Pres Agnew's allegation that it had engaged in campaign of news leaks directed against him and says that subpoenas to newsmen to prove there was campaign are merely 'fishing expeditions,' memo to US Dist Judge Hoffman; declares its opposition to Agnew's efforts to call off Baltimore grand jury that is looking into possible criminality on his part; says it does not intend to fight subpoenas its officers have recd; memo says it is 'substance of publicity, not its source' that bears on grand jury's ability to consider fairly evidence presented before it; notes that evidence gathered against Agnew is so entwined with evidence gathered against other present and former Md officials that Agnew's case cannot be dropped without affecting others; memo strongly objects to subpoenas issued to newsmen; attys for 11 reporters and news orgns call subpoenas 'virtually unprecedented'; file motion asking for wk's delay in responding to subpoenas from Oct 11 to Oct 18; Hoffman summarily rejects request; several of attys say they are considering possible appeal of judge's action; newsmen argue that 1 of key issues at stake is 'right and duty of press to alert the voters and their reprs to activities which may constitute grounds for impeachment'; some of arguments newsmen are expected to raise in efforts to quash subpoenas noted; Reporters Com for Freedom of the Press announces on Oct 8 that it will attempt to enter case on side of newsmen and editors

W Safire comment says Agnew's real opponent is power of state to deny individual citizen his rights, a Justice Dept that will abuse new immunity statutes to coerce testimony to 'get' a big fish, a prosecutor who will spread pronouncement of guilt to every lawyer in case so that his prejudicial judgment cannot help but see print and thereby tamper with jury's opinion; says that to challenge abuse of power is to fight the good fight but Agnew is using weapon of subpoena like bludgeon to fight the wrong fight--the grudge fight against press; says there is still time for Agnew to drop 'sideshow' of subpoenaing press and to get on with counterattack against scalp-hunters' abuse of power; says if Agnew fights for principle, for individual's rights against abusive power of reputation-conscious prosecutors, he will win, but if he fights for Agnew alone, he will deserve to lose
